Dear Chief Justice Budd,
As you are fully aware, a frame-up is a violent crime. You have indisputable evidence of a frame-up against Dr. Bharani Padmanabhan, hence the total silence about the facts.
On October 31, 2024, you issued an unspeakably mendacious unsigned decision claiming the matter of gross misconduct by your court is moot. The issue is not moot. Dr. Bharani presented you with a forensic expert’s sworn affidavit with unequivocal scientific proof that your court system secretly spliced out testimony from your court’s audio record on behalf of Attorney General Maura Healey.
You discarded it without comment as just his “claim.” What more does anyone need to furnish? Your support for discrimination and gross misconduct continues. Is this what you meant by “championing restorative justice?” When will you stop supporting unlawful discrimination?
I have standing on the issue of the framing of a minority victim due to my history as a court official and fifty years as an EEOC officer who fought against workplace discrimination.
By copy to Justices Dewar, Gaziano, Georges, Kafker, Wendlandt, and Wolohojian, I ask whether they all approved of the frame-up against Dr. Bharani. Did they also approve of the total silence regarding the reason for denial of his Rule 60b motion at 6pm on a Friday evening? This itself is a confession that your denial is corrupt and unjust.
Did all the justices agree to discard scientific evidence of tampering with court audio? Is that why the case caption was altered to conceal the names of AG Andrea Campbell and Chief Justice Heidi Brieger? Why did your court conceal those names?
I have known your father for 50 years and have dedicated my life to actually combating discrimination against women and minorities instead of simply reciting slogans in order to climb the career ladder through empty virtue signaling.
You already know I am personally devastated that you, Wayne Budd’s own child, chose to actively support brazen discrimination and retaliation against minority immigrant physician Dr. Bharani Padmanabhan, who had done only good for the people of Massachusetts and had made it to the US solely on merit.
This is what I wrote to your father (and your father acknowledged receipt):
“And, Kimberly, your own daughter, affirmed this! I couldn’t believe it for days! Where did we go so wrong, Wayne? What have we been doing all our lives? If our own children don’t support what we fought for our entire lives, what have we achieved? I am 80 years old now, and just devastated by what she has done.”
Did you really not mean anything you said when appointed to the post of Chief Justice? Your actions, in the public record, prove that you, at the very least, misled the people of Massachusetts.
If the Wayne Budd I have known for fifty years had become Chief Justice instead, it would have been 100% different. Your actions are the exact opposite of what Wayne desired as his legacy.
And I proved to you that your court system actively supported Brian Sullivan lying to three courts in order to destroy an honest physician who upheld his oath to help patients and avoid harming them, and who desired only the rule of law.
When you assumed office, as you are Wayne Budd’s daughter, I thought you would do something positive for Black people and other minorities.
Personally, I have no hope that you ever will ensure the rule of law, repudiate your court’s defining Separate-But-Equal doctrine with Double Docket system (“docket apartheid”), or punish officials and judges involved in secretly splicing out testimony from court audio recordings.
Why do you hate Blacks and minorities this much? It is unfathomable as you yourself are one.
There is nothing more to say, other than to record publicly that you actively covered up secret splicing of court audio and the framing of an innocent physician by Attorney General Andrea Campbell and Chief Justice Heidi Brieger by suborning perjury.
Tellingly, your court altered the case caption to conceal Campbell’s and Brieger’s names in addition to sweeping audio splicing under the rug. Is this the right thing to do for Black and minority victims? Is this “restorative justice?”
The buck stops at your desk as Chief Justice. The time for living by your own words, the time for real restorative justice is now.
Respectfully, Douglas K. Kinan
